The existing legislation provides the facility under both Health & Safety law and Criminal Law for individuals of any status to be prosecuted.
Although the new Act is designed specifically to target Organisations as such, it does not follow that individuals will not be prosecuted.

Remember it is not all about personal liability, this Act carries with it unlimited fines and the requirement to publish notice of prosecution as well as taking remedial action
